The specific services provided to any client, the scope of those services, the deliverables, the timeline, the fees, and the terms governing the service relationship are set forth in the individual service agreement executed between Aesthetic Marketing and each client.


3. Site Use and Acceptable Use

3.1 Permitted Use

You may access and use our Site for the purpose of learning about Aesthetic Marketing’s services, submitting inquiries, scheduling discovery calls, and accessing publicly available content we publish. You must be at least 18 years of age to use our Site or engage our services.

Aesthetic Marketing retains the right to reference client work in our portfolio, case studies, and marketing materials unless a client has specifically requested confidentiality in their service agreement.

4.3 Trademarks

“Aesthetic Marketing” and related logos and service names are trademarks of Aesthetic Marketing. You may not use our trademarks without our prior written consent. Nothing in these Terms grants you any right to use our trademarks, trade names, or other brand elements.


5. Disclaimers

5.1 No Guarantee of Specific Results

Aesthetic Marketing provides digital marketing services with the goal of improving our clients’ patient acquisition, online visibility, and digital presence. However, we do not and cannot guarantee specific results — including specific keyword rankings, specific traffic volumes, specific numbers of patient inquiries or consultation bookings, or specific revenue outcomes — from any of our services.

Digital marketing results are influenced by many factors outside our control, including search engine algorithm changes, competitor activity, market conditions, practice-specific conversion rates, and the quality of the practice’s patient experience. We provide honest, data-supported projections based on our experience and our analysis of each client’s market — but those projections are estimates, not guarantees.

5.2 Site Content Accuracy

The content on our Site is provided for informational purposes only. While we make reasonable efforts to ensure the accuracy and currency of the information we publish, we make no representations or warranties — express or implied — about the completeness, accuracy, reliability, suitability, or availability of any information on the Site. 6. Limitation of Liability

To the fullest extent permitted by applicable law, Aesthetic Marketing and its officers, directors, employees, agents, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, loss of revenue, loss of data, loss of business opportunity, or loss of goodwill — arising out of or related to your use of our Site or our services, even if we have been advised of the possibility of such damages.

To the fullest extent permitted by applicable law, Aesthetic Marketing’s total cumulative liability to any client for all claims arising out of or related to a service agreement shall not exceed the total fees paid by that client to Aesthetic Marketing in the three months immediately preceding the event giving rise to the claim.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under applicable law.


7. Indemnification

You agree to indemnify, defend, and hold harmless Aesthetic Marketing and its officers, directors, employees, agents, and contractors from and against any claims, liabilities, damages, losses, costs, and expenses — including reasonable attorneys’ fees — arising out of or related to:

  • Your violation of any applicable law or regulation

8. Client Responsibilities

Clients who engage Aesthetic Marketing for services agree to fulfill the following responsibilities, which are necessary for Aesthetic Marketing to perform effectively:

Timely review and approval. Clients agree to review and respond to content calendars, ad creative, website pages, written content, and strategy recommendations within the timeframes specified in the applicable service agreement. Delays in client review and approval may affect campaign timelines, content publishing schedules, and overall program performance, for which Aesthetic Marketing is not responsible.

Accurate information. Clients agree to provide accurate, complete, and current information about their practice, their services, their patient population, their competitive market, and any other information relevant to the services being performed. Aesthetic Marketing is not responsible for service performance issues arising from inaccurate or incomplete information provided by the client.

Platform access. Clients agree to provide Aesthetic Marketing with the access credentials, administrative permissions, and platform access necessary to perform the agreed services, including access to website backends, Google accounts, Meta Business accounts, and any other platforms relevant to the engagement. Aesthetic Marketing will maintain the confidentiality of all access credentials provided.

Patient consent compliance. Clients are independently responsible for obtaining all necessary patient consents before providing Aesthetic Marketing with any patient photography, video, or testimonial content for use in marketing materials. Aesthetic Marketing assumes no responsibility for the client’s compliance with applicable patient consent requirements.

HIPAA compliance. Aesthetic Marketing is a marketing agency and is not a HIPAA Covered Entity or Business Associate in relation to our clients’ patient populations. Clients are independently responsible for their own HIPAA compliance obligations. Aesthetic Marketing does not access, receive, or process individually identifiable protected health information (PHI) in the course of our marketing services. If any service engagement requires Aesthetic Marketing to access PHI, a separate Business Associate Agreement will be executed prior to that access.

Regulatory compliance. Clients are independently responsible for ensuring that the services they offer are properly licensed, that their providers hold appropriate credentials, and that their marketing content complies with all applicable federal, state, and professional regulations governing the advertising of medical and aesthetic services in their jurisdiction.


9. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions.

Any dispute, claim, or controversy arising out of or relating to these Terms or to Aesthetic Marketing’s services that cannot be resolved through good-faith negotiation between the parties shall be submitted to binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration shall take place in Maricopa County, Arizona. The decision of the arbitrator shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the unauthorized use or disclosure of intellectual property or confidential information.

You agree that any claims against Aesthetic Marketing must be brought individually and not as part of any class action, class arbitration, or representative proceeding.


10. Termination

10.1 Site Access

We reserve the right to terminate or restrict your access to our Site at any time, without notice, for any reason — including if we believe you have violated these Terms or applicable law.

10.2 Service Agreements

The termination provisions applicable to client service agreements are set forth in each individual service agreement. In general, after the completion of any applicable initial engagement term, service agreements may be terminated by either party with 30 days written notice. Upon termination, Aesthetic Marketing will provide the client with all content assets, access credentials, and account information produced or managed on the client’s behalf during the engagement.

Aesthetic Marketing reserves the right to terminate a service agreement immediately and without notice if a client engages in conduct that violates applicable law, makes material misrepresentations about their practice or services, or engages in behavior that creates reputational, legal, or financial risk to Aesthetic Marketing.


11. Changes to These Terms

We reserve the right to update or modify these Terms at any time. When we make material changes, we will update the “Last Updated” date at the top of this document. For active clients, we will provide notice of material changes to these Terms with reasonable advance notice.

Your continued use of our Site following any update to these Terms constitutes your acceptance of the revised Terms. If you do not agree with any update to these Terms, you should discontinue use of our Site and notify us if you wish to discuss the impact on any existing service engagement.


12. Miscellaneous

Entire Agreement. For Site visitors, these Terms constitute the entire agreement between you and Aesthetic Marketing with respect to your use of the Site. For clients, the applicable signed service agreement, together with these Terms, constitutes the entire agreement with respect to the service relationship.

Severability. If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be limited or eliminated to the minimum extent necessary and the remaining provisions will continue in full force and effect.

Waiver. Aesthetic Marketing’s failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

Assignment. You may not assign your rights or obligations under these Terms without our prior written consent. Aesthetic Marketing may assign its rights and obligations under these Terms without restriction in connection with a merger, acquisition, or sale of assets.

Force Majeure. Aesthetic Marketing shall not be liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including acts of God, natural disasters, government actions, platform outages, internet infrastructure failures, or pandemic-related disruptions.
